SECTION 10-33. C-5A (HIGHWAY COMMERCIAL) ZONING DISTRICT.

10-33.1 INTENT

The intent of the C-5A District is to accommodate the demand for a wide variety of automobile - oriented retail, service and office uses which require attractive, low - profile, ground - oriented building accommodation having direct visual exposure to and access from urban arterial highways. The C-5A District is intended to provide outdoor areas for the display of goods, equipment or materials for some specified uses.

10-33.2 USES PERMITTED

Subject to all other provisions of this By - Law, the following uses only shall be permitted in the C-5A District:
1. Animal Hospital
2. Building or Garden Supplies
3. Car or Truck Rental
4. Car Sales or Service
5. Car or Truck Wash
6. Commercial Auction
7. Commercial Office
8. Commercial Retail
9. Commercial Service
10. Farmer's Market
11. Gasoline Service Station, subject to the provisions of Section 27 of this By - Law
12. Nursery or Greenhouse
13. Recreational Vehicle Sales or Service
14. Restaurant

10-33.3 REGULATIONS

All permitted uses shall be subject to the following regulations:
1. SITE REGULATIONS:
a , The minimum SITE AREA shall be 500 m2 ( 5,382 square feet ) ;
b , The minimum SITE WIDTH shall be 15.0 m ( 49.0 feet )
2. BUILDING REGULATIONS:
a , The maximum SITE COVERAGE shall be 50 % ;
b , The maximum FLOOR AREA RATIO shall be 1.00 ;
c , No building shall exceed a HEIGHT of 12.0 m ( 39 feet ) or two ( 2) storey, whichever is less.
3. YARD AND SETBACK REQUIREMENTS:
a , Principal buildings shall not require FRONT, REAR or SIDE YARDS ;
b , Accessory buildings shall have minimum FRONT, REAR and SIDE YARDS of 1.2 m ( 4 feet ) ;
c , Notwithstanding subsections ( a ) and ( b ) above, a minimum SETBACK of 3.0 m ( 10 feet) ) shall be provided from any site line which abuts a site in an SR or UR District without the intervention of a highway ;
d , Two ( 2 ) or more principal buildings shall be permitted on a site, provided they are separated by a minimum distance of 4.5 m ( 15 feet ) ; .
4. OFF - STREET PARKING AND LOADING REQUIREMENTS:
Section 29 shall apply.
5. OTHER REGULATIONS:
a , Every use shall be enclosed within a building or a sight-obscuring fence except for permitted outdoor display, sales, rental or storage yards, a Gasoline Service Station, a Nursery or Greenhouse, and off - street parking and loading facilities ;
b , A sight - obscuring fence not less than 2.0m ( 6.6 feet ) in height shall be provided maintained along any site line which abuts a site in an SR or UR District, unless separated by a highway other than lane ;
c , The maximum GROSS LEASABLE FLOOR AREA of any Commercial Office or Commercial Retail use in one ( 1 ) tenancy shall be 280 m2 ( 3.014 square feet );
d , See Section 21 for landscaping requirements.
